Terms of Service

These Terms of Service (the Terms) govern your access to and use of EqCheck, including eqcheck.app, the EqCheck MCP surface, and EqCheck’s rewrite and judge operations (collectively, the Service).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. About EqCheck

EqCheck provides tools for checking and adjusting the voice, tone, and style of written content. The current Service exposes two primary operations:

  • rewrite: rewrites submitted text toward a target voice, tone, or style; and
  • judge: evaluates submitted text against a target voice, tone, or style and returns a score, verdict, and/or rationale.

The current external Service is offered without signup, an account, or usage-based billing. EqCheck may change that model in the future.

2. Eligibility and Authority

You may use the Service only if you are legally capable of agreeing to these Terms and your use is permitted by applicable law.

If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and “you” includes that organization.

3. Using the Service

You may access EqCheck through an MCP-capable client or another interface made available by EqCheck.

You are responsible for:

  • the content you submit;
  • ensuring that you have the rights and authority needed to submit that content;
  • reviewing EqCheck’s output before relying on, publishing, sending, or distributing it; and
  • complying with laws, contractual duties, professional obligations, and third-party rights applicable to your use.

4. Your Content

As between you and EqCheck, you retain your rights in text and other content you submit to the Service (Your Content).

You grant EqCheck a limited, non-exclusive right to host, transmit, process, reproduce, and transform Your Content solely as reasonably necessary to provide, secure, maintain, evaluate, and troubleshoot the Service and to comply with law.

You represent and warrant that your submission and EqCheck’s processing of Your Content as contemplated by these Terms do not violate applicable law or the rights of another person.

5. AI-Generated and AI-Assisted Output

EqCheck uses AI systems. Outputs may be incomplete, inaccurate, inconsistent, inappropriate for your context, or different from what you intended.

A judge verdict is an automated assessment, not an objective determination that text is correct, safe, lawful, effective, or appropriate. A rewrite result may change meaning, emphasis, nuance, or factual content.

You are responsible for reviewing outputs before use. EqCheck should not be treated as a substitute for professional, legal, medical, financial, compliance, or other expert advice.

6. Acceptable Use

You may not use the Service to:

  • violate applicable law, regulation, court order, or another person’s rights;
  • submit content that you do not have the right to provide;
  • distribute malware, malicious code, or content intended to compromise systems or accounts;
  • probe, scan, exploit, or interfere with the security, integrity, or availability of the Service;
  • bypass or defeat technical restrictions, safety controls, rate limits, or access controls that EqCheck may implement;
  • use automated methods in a way that materially degrades the Service for others or creates unreasonable operational cost;
  • misrepresent EqCheck output as having been independently verified or approved by EqCheck; or
  • use the Service to facilitate fraud, deception, abuse, or other unlawful conduct.

EqCheck may restrict or block access where reasonably necessary to protect the Service, users, infrastructure, or third parties, even if the current version does not require an account.

7. Free Access, Usage Controls, and Future Pricing

The current external version of EqCheck is available without signup, subscriptions, or formal usage quotas.

This is not a promise that the Service will remain free, unlimited, or ungated. EqCheck may introduce rate limits, authentication, usage controls, paid access, quotas, or other restrictions in the future. Unless otherwise stated, those changes will apply prospectively after they are introduced.

8. Service Availability and Changes

EqCheck may modify, suspend, limit, or discontinue any part of the Service at any time, including an operation, model, protocol, endpoint, or feature.

EqCheck does not guarantee uninterrupted availability, any minimum service level, permanent compatibility with a particular MCP client, or continued access through a particular URL or protocol.

9. Third-Party Services and Clients

EqCheck may rely on third-party AI, hosting, infrastructure, security, or other providers. You may also use EqCheck through a third-party MCP client or agent host.

EqCheck is not responsible for third-party products or services, including their availability, security, content, terms, or privacy practices. Your use of those third-party services may be governed by separate terms.

10. EqCheck Intellectual Property

Except for Your Content and third-party materials, EqCheck and its licensors retain all rights, title, and interest in the Service, including its software, interfaces, prompts, workflows, design, documentation, trademarks, and other materials.

These Terms do not grant you ownership of the Service or permission to use EqCheck’s name, trademarks, or branding except as necessary to truthfully identify the Service.

11. Feedback

If you voluntarily provide feedback, suggestions, or ideas about EqCheck, you grant EqCheck a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without restriction or compensation to you.

12. Privacy

EqCheck’s processing of personal information is described in the EqCheck Privacy Policy. By using the Service, you acknowledge that information may be processed as described there.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” EqCheck disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and availability.

EqCheck does not warrant that outputs will be accurate, unique, error-free, suitable for your purpose, or consistent with any particular human reviewer’s assessment.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, EqCheck will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, data, goodwill, or opportunity, arising out of or related to the Service, even if EqCheck has been advised of the possibility of such damages.

To the maximum extent permitted by law, EqCheck’s total aggregate liability arising out of or related to the Service or these Terms will not exceed [LIABILITY CAP].

The limitations in this section apply only to the extent permitted by applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless EqCheck and its personnel, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising out of or related to:

  • Your Content;
  • your misuse of the Service;
  • your violation of these Terms; or
  • your violation of applicable law or another person’s rights.

16. Termination and Access Restrictions

You may stop using EqCheck at any time.

EqCheck may suspend, restrict, or block access to the Service if reasonably necessary to address abuse, security risk, excessive use, legal requirements, or violations of these Terms. Because the current Service may not use accounts, access restrictions may be implemented at the request, client, network, protocol, or infrastructure level.

Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and dispute terms.

17. Governing Law and Disputes

These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-laws rules.

Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in [VENUE / COURTS OR ARBITRATION FORUM], except where applicable law gives you a non-waivable right to bring a claim elsewhere.

18. Changes to These Terms

EqCheck may update these Terms from time to time. The updated version will be posted with a revised effective date. Your continued use of the Service after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.

If a change materially affects existing rights or obligations, EqCheck may provide additional notice where reasonably appropriate or legally required.

19. Miscellaneous

These Terms, together with the EqCheck Privacy Policy and any additional terms expressly presented for a particular feature, form the agreement between you and EqCheck concerning the Service.

If any provision is held unenforceable, the remaining provisions will remain in effect. EqCheck’s failure to enforce a provision is not a waiver of its right to do so later. You may not assign these Terms without EqCheck’s prior written consent; EqCheck may assign them in connection with a restructuring, transfer, or change in control, subject to applicable law.
